Casewall Terms of Service
Effective: October 17, 2026
Version: tos-0.2
These Terms of Service ("Terms") are an agreement between you and XenneX LLC ("XenneX", "we", "us"), a Louisiana limited liability company, which operates Casewall at casewall.org and its apps (the "Service"). By creating an account or using the Service, you agree to these Terms, our Acceptable Use Policy (the "AUP") and our Privacy Policy. The AUP is part of these Terms. If you don't agree, don't use the Service.
1. What Casewall is, and what it isn't
Casewall is a workspace for organizing information about cases: exhibits, timelines, maps, people, theories and notes, alone or with collaborators.
Casewall is not:
- a law enforcement agency, a licensed investigator, or a law firm. We don't investigate anything for you, and nothing on the Service is legal advice;
- a consumer reporting agency. You may not use the Service for any purpose covered by the Fair Credit Reporting Act (see the AUP, section 6);
- a source of verified facts. Content comes from users and from AI tools that can be wrong. You are responsible for checking it.
We don't create, verify or endorse user content. AI suggestions never set anyone's Suspect or Person of Interest role.
Investigator licensing. If you perform investigations for others, you are responsible for holding any license your state requires (for example, under Louisiana's private investigator law, La. R.S. 37:3500 and following). A Casewall badge, role or plan is not a license or an endorsement.
If you have information about a crime or someone is in danger, contact law enforcement. In an emergency, call 911.
2. Eligibility and accounts
- You must be at least 18 to use the Service.
- You must give accurate account information, keep your credentials secure, and tell us promptly at casewall-legal@xennex.app (subject line "SECURITY") if you think your account has been compromised. You're responsible for activity on your account.
- Some features require a fresh two-factor check, for example exporting original files.
- If you use the Service for an organization, you confirm that you're authorized to bind it to these Terms, and "you" includes that organization.
- One person per account. Don't share accounts or create accounts to get around a suspension, a rate limit or a moderation decision.
3. Cases, roles and visibility
- Private cases are visible only to people the case owner or admins let in. Public cases are readable by anyone, including people without an account.
- Making a case public, or adding content to a public case, is publishing it to the world. The AUP's Public Case Rules apply to all public content, and some content isn't allowed on public cases at all. Before a case goes public, its owner confirms that it follows those rules.
- Case owners and admins control membership, roles, review requirements and exports for their case. They are responsible for how they configure their case and for who they let in.
- Content you add to a case stays attributed to you in the case history. Owners, admins and moderators of that case may edit, hide, revert or remove it under the case's rules.
- Submissions you send to someone else's case can be accepted, edited or rejected by that case's owners and admins. Once accepted, they become part of that case.
4. Your content
"Your Content" means anything you upload, write or submit: files, images, video, audio, documents, notes, theories, comments and case structure.
- You keep ownership of Your Content.
- License to us. You grant XenneX a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transcode, analyze (including with AI tools as described in section 7), display and distribute Your Content, only as needed to operate, secure, back up and improve the Service and to enforce these Terms. For content on public cases, the license also covers displaying it publicly. The license ends when Your Content is deleted from the Service, except for copies in backups and records we must keep (section 13).
- License to your collaborators. You grant the members of each case you contribute to a license to view, use, edit, cite and export your contributions within and from that case, as the case's settings allow. This license continues for contributions that remain in the case after you leave it.
- Your responsibility. You're solely responsible for Your Content and for having the right to upload it. You confirm that:
- you own it or have every permission needed to upload and share it the way you're sharing it;
- you have a lawful basis to possess it and, if it shows identifiable people, to post it where you're posting it (AUP, section 3);
- when you state something as fact, you have a factual basis for it and can point to the source;
- it doesn't violate the AUP, anyone's rights, or any law.
- We don't pre-screen everything. We may review content, but we have no obligation to monitor it and don't endorse it.
5. Plans, credits and payment
Paid plans and credit purchases may not be available during the beta. When they are, these rules apply.
- Renewal and cancellation. Paid plans are billed monthly or yearly, in advance, and renew automatically at the then-current price until cancelled. You can cancel any time in Settings; cancellation takes effect at the end of the current billing period, and you keep access until then. Fees are non-refundable except where the law requires otherwise.
- Free trials.
- A trial needs a payment card. When it ends, your card is charged for the plan you chose and the plan renews as above, unless you cancel before the trial ends.
- Trials are limited to one per person and one per payment card. If a card or account has already had a trial, the plan starts without one and your card is charged straight away.
- We may change or end trial offers at any time.
- Plan credits. Paid plans include AI credits each month, yearly plans too. Plan credits reset every month: unused ones don't roll over, and they end when your plan does. They're spent before credits you've bought.
- Free plan credits. On the Free plan, we top your wallet up to 10 credits once a month. It's a top-up, not an addition: if you already have 10 or more credits, including ones you've bought, you get none that month. This is a promotion we can change or end.
- Subscriber pricing. While a paid plan is active (not during a trial), credit packs cost 10% less. The price you pay is the one shown at checkout.
- Failed payments. If a renewal payment fails, we retry it for up to 14 days and your plan stays active meanwhile. If it still hasn't been paid, your account moves to the Free plan. Your files and purchased credits are kept, but you can't upload more while you're over the Free plan's storage limit.
- AI credits pay for AI processing. Credits:
- have no cash value, can't be redeemed for money, and can only be transferred as the Service allows (for example, contributing credits to a case's pool);
- are reserved when an AI job starts and charged for what the job actually uses; any reserved but unused credits are released;
- are non-refundable once used.
- Expiry. Purchased credits expire 24 months after purchase. Plan credits reset monthly, as above. Promotional credits, including sign-up, trial and free monthly credits, may expire, and they have no value when your account ends.
- Case credit pools. Anyone allowed may contribute credits to a case's pool. Contributions to a case pool are final: they aren't refunded to the contributor, and the case owner and admins decide how the pool is spent. If a case is deleted, its remaining pool credits go to the case owner's wallet.
- Free import. The first eligible AI import may be free, up to the limit shown before you start. This is a promotion we can change or end.
- Price changes. We may change prices with at least 30 days' notice. The change applies at your next renewal, and you can cancel before then.
- Taxes are extra where applicable. Payments are processed by Stripe under its terms.
6. Reports, moderation and enforcement
- How reports are handled today. Reports about child sexual abuse material (CSAM) and non-consensual intimate imagery (NCII) go straight to XenneX staff: the reported file is hidden as soon as the report is filed, and case moderators never see it. Other reports about a public case go to that case's moderators first. You can ask XenneX staff to review any report, or a moderator's decision, by emailing casewall-legal@xennex.app. Staff decisions override case moderators.
- What we may do. We may remove, hide, restrict or make private any content, and suspend or terminate any account or case, if we reasonably believe it violates these Terms or the AUP, creates legal risk, or puts anyone in danger. We may make a public case private, lock it, or hold it for review while we look into a report. We'll usually tell you what we did and why, unless doing so would be unsafe or unlawful.
- Response times. Our response-time targets for each kind of report are in the AUP, section 8. They are targets, not guarantees of an outcome.
- Intimate images (TAKE IT DOWN Act). If an intimate image of you was published on Casewall without your consent, follow the steps in the AUP, section 8.2. We remove valid requests within 48 hours.
- Copyright (DMCA). Send copyright notices to our designated agent by email, as described in the AUP, section 8.5. If your content was removed and you believe that was a mistake, you can send a counter-notice. We restore content 10 to 14 business days after a valid counter-notice unless the complainant tells us they've filed a court action.
- Repeat infringers. We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright or repeatedly violate the AUP.
- Appeals. You can appeal a moderation decision about your content or account within 30 days at casewall-legal@xennex.app (subject line "APPEAL"). A different person from the one who made the original decision will review it where practical. We aim to respond within 14 days.
7. AI features
- The Service uses AI models to tag, transcribe, summarize, extract and draft (for example, AI Auto-Ingest).
- Who processes your content. Content sent for AI processing goes to Amazon Web Services (Amazon Bedrock, using Amazon Nova and Anthropic Claude models in US regions) and, for audio transcription, to Groq. Neither provider uses your content to train models. Our Privacy Policy lists all of our service providers.
- Who can run AI. AI features run when you, or a case member allowed to use AI, start them. Case owners control who can run AI through the case's role permissions. There is no separate switch to turn AI off for a whole case yet.
- AI output isn't fact. AI output can be incomplete or wrong. It's labeled as AI-generated and stays in draft or review until a person accepts it. It never replaces your own judgment. Our AI tools are designed not to originate accusations and not to score or rank people as suspects. Don't use AI output as evidence without checking it against its sources.
- You're responsible for AI output you accept into a case or publish, the same as for anything else you write.
8. Our intellectual property
The Service, its software, design and trademarks belong to XenneX or its licensors. These Terms don't give you any rights to them except to use the Service as allowed here. If you send us feedback, we may use it without obligation to you.
9. Third-party services and links
The Service may link to or integrate with third-party sites and services (for example, sign-in providers, web archives and payment processors). We're not responsible for them, and your use of them is under their terms.
10. Disclaimers
Casewall is in beta. Features may change, break or go away, so keep your own copies of anything important.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, XENNEX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT CONTENT (INCLUDING AI OUTPUT) IS ACCURATE, OR THAT ANY EXPORT WILL BE ACCEPTED AS EVIDENCE BY ANY COURT OR AGENCY.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- XENNEX WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS;
- XENNEX'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WON'T EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $100;
- XENNEX ISN'T LIABLE FOR CONTENT POSTED BY USERS OR FOR THE CONDUCT OF USERS OR THIRD PARTIES, ON OR OFF THE SERVICE.
Some jurisdictions don't allow some of these limits, so they may not all apply to you.
12. Indemnity
You'll defend, indemnify and hold harmless XenneX and its members, officers, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising from or related to:
- Your Content, including any claim that it is defamatory, invades privacy or publicity rights, or infringes intellectual property;
- your use of the Service, including anything you do based on information from it;
- your violation of these Terms, the AUP or any law.
We'll notify you of the claim and may take control of the defense at our own cost. You may not settle a claim that imposes an obligation on us without our written consent.
13. Termination, deletion and retention
- Closing your account. Self-serve account and case deletion aren't available yet. To close your account, email casewall-legal@xennex.app and we'll disable it. We'll have self-serve deletion in place before public launch, and the Privacy Policy explains what happens to your data in the meantime.
- We may suspend or terminate your access under section 6, or if we stop offering the Service. If we discontinue the Service entirely, we'll give at least 30 days' notice and a way to export your cases where the law allows.
- What we may keep. We keep content or records where the law requires it or where it's needed to handle a legal claim, including material we must preserve for law enforcement. Contributions you made to other people's cases stay in those cases under the license in section 4.
- Sections 4 (the licenses needed for content that remains in cases and backups), 5 (amounts owed), 10, 11, 12, 13 and 15 survive termination.
14. Law enforcement and legal requests
We disclose user data only in response to valid legal process (such as a subpoena, court order or warrant), or in an emergency involving danger of death or serious injury. We'll notify affected users before disclosing their data unless the law prohibits it or there's such an emergency.
15. Disputes, governing law and changes
- Governing law. The laws of the State of Louisiana and applicable US federal law govern these Terms, without regard to conflict-of-laws rules.
- Venue. Any dispute that isn't arbitrated goes to the state or federal courts located in Orleans Parish, Louisiana.
- Arbitration and class waiver. Disputes between you and XenneX are resolved by binding individual arbitration, not in court, except that:
- either party may bring an individual claim in small-claims court instead; and
- either party may ask a court for an injunction to stop misuse of intellectual property.
Claims may only be brought individually, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitration will be administered by [arbitration provider, rules, fees and seat: to be supplied by counsel].
- Opting out of arbitration. You may opt out of arbitration within 30 days of first accepting these Terms by emailing casewall-legal@xennex.app with the subject line "ARBITRATION OPT-OUT". If you opt out, the venue rule above applies.
- Changes to these Terms.
- We may update these Terms. Material changes take effect 30 days after we give notice, by email or in the Service.
- If you keep using the Service after the effective date, that means you accept the changes.
- Each version is numbered and dated.
- General.
- These Terms, the AUP and the Privacy Policy are the entire agreement between us.
- If any provision is unenforceable, the rest still applies.
- If we don't enforce a provision, we haven't waived it.
- You may not assign these Terms without our consent. We may assign them in a merger, acquisition or sale of assets.
